Equality
Disabled people with a degree of disability (GdB) of less than 50 but at least 30 can be treated in the same way as severely disabled people (Section 2 (3) SGB IX). The prerequisite is that they cannot obtain or retain a suitable job as a result of their disability without equalisation.
Equal status is granted by the employment agency at the request of the disabled person (Section 68 Para. 2 SGB IX), which may also consult the department, the staff council and the representative body for severely disabled employees beforehand. The equalisation becomes effective (retroactively) on the day the application is received by the Employment Agency.
